All services are subject to a written estimate and agreement prior to commencement of work. Information on this website is provided for general informational purposes and does not constitute a binding offer or contract.
All estimates provided by Orinda Masonry are based on an on-site assessment of the project scope. Written estimates are provided at no charge and carry no obligation. An estimate is not a final contract until both parties have signed a written agreement.
Prices in a written estimate are valid for 30 days from the date of issuance. If project conditions change materially after the estimate is accepted - including but not limited to discovery of concealed damage, changes in material costs, or changes in project scope requested by the customer - we reserve the right to revise the estimate and provide an updated written agreement before proceeding.
Any price discussed verbally or displayed on our website is illustrative only and is not binding. The only binding price is the one in a signed written contract.
Project start dates are confirmed in writing after a contract is signed. We make every effort to adhere to agreed schedules. Start dates may be adjusted due to weather conditions, permit processing timelines, material availability, or circumstances beyond our control. We will notify you of any changes as soon as reasonably possible.
If you need to reschedule or cancel a project, please contact us at least 5 business days before the agreed start date. Cancellations made after work has begun may be subject to charges for work completed and materials purchased to that point. Specific cancellation terms will be outlined in your written contract.
We reserve the right to decline or discontinue services in situations where site conditions are unsafe or access to the property cannot be reasonably secured.
Payment terms are established in the written contract for each project. Typically, a deposit is required before work begins, with the remaining balance due upon project completion. For larger projects, progress payments may be scheduled at defined milestones.
Accepted payment methods will be specified in your contract. Unpaid balances may accrue interest at the maximum rate permitted byCalifornia law. Orinda Masonry reserves the right to suspend work on any project where payment is overdue.
In the event that Orinda Masonry must engage a collection service or legal counsel to recover an unpaid balance, the customer agrees to be responsible for reasonable collection costs and attorneys' fees as permitted by California law.
Where required by local or state law, Orinda Masonry will obtain the necessary building permits before commencing structural work. Permit fees, when applicable, will be identified in the written estimate. The customer is responsible for providing reasonable access to the property for inspections by permitting authorities.
Customers must not request or instruct Orinda Masonry to perform work without required permits. If a customer insists on proceeding without legally required permits, Orinda Masonry reserves the right to decline that portion of the work.
Any warranty covering completed work will be specified in the written contract for that project. Warranties, where provided, apply to the specific work performed and materials installed byOrinda Masonry under that contract.
Warranty coverage does not apply to damage caused by: events beyond our control including earthquakes, flooding, or other acts of nature; improper use or modification of completed work by the customer or third parties; failure of adjacent structures or systems not part of our scope of work; or normal wear consistent with the nature of masonry materials.

Our total liability for any claim related to a specific project shall not exceed the amount paid by the customer for that project. Nothing in these terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.
If a dispute arises between you and Orinda Masonry, we encourage you to contact us directly first. Most issues can be resolved through direct communication without formal proceedings.
